Terms of Service

These Terms govern any purchase, deposit, or shipping arrangement made through fnexs.com. By placing a deposit or requesting a quote, you agree to the terms below.

1. Our Role

FNEXS acts as a purchasing and export agent on your behalf, sourcing vehicles from Japanese auctions or dealer stock, arranging payment on your behalf where applicable, and coordinating export shipping. FNEXS does not manufacture or warrant the vehicles themselves; vehicles are sold on an as-is basis, sourced from third-party auctions, dealers, or private sellers.

2. Deposits

To secure a vehicle, a deposit is required before we proceed:

  • Auction Route: 30% of the bid amount, paid before bidding begins.
  • Dealer / Whole-sale Route: 50% of the total purchase amount, paid once the vehicle is confirmed available.

Deposits secure our commitment to bid or purchase on your behalf and are generally non-refundable once a bid is placed or a purchase is confirmed, except as described in Section 3.

3. Auction Outcomes & Refunds

If a bid is unsuccessful and no vehicle is secured, your deposit will be refunded in full, minus any payment processing fees already incurred (e.g. PayPal or wire transfer fees). Once a vehicle has been successfully secured through auction or dealer purchase, the deposit is non-refundable, as it reflects funds already committed on your behalf.

4. Pricing & Fees

We operate on an open-book basis: you will be shown the actual purchase price (auction winning bid screenshot, or dealer invoice) with no markup added before you see it. In addition to the vehicle price, the following fees apply and are itemized separately:

  • Agency Fee: ¥85,000 JPY flat, or 3% of the purchase price for vehicles over ¥3,000,000
  • Auction Fee, Port Entry Fee, and Inland Transportation, as itemized on our Pricing page
  • Shipping cost (RoRo or Container), calculated based on vehicle size and destination

Fees are subject to change without notice for future transactions, but any fees already quoted and agreed to in writing for a specific vehicle will not be increased.

5. Final Payment

The remaining balance is due only after we confirm the vehicle has been officially secured on your behalf. Payment must be received before we proceed to arrange shipping. Accepted payment methods are PayPal, Wise, and direct bank transfer, as listed on our Payment page. Any transfer fees charged by your bank or payment provider are the responsibility of the buyer.

6. Shipping & Delivery

Shipping method (RoRo or Container) will be confirmed with you before booking. Estimated delivery times are approximate and may be affected by factors outside our control, including weather, port congestion, customs processing, and carrier delays. FNEXS is not liable for delays caused by third-party shipping carriers or customs authorities.

7. Import Compliance

It is the buyer's sole responsibility to confirm that a vehicle is legally eligible for import into their destination country before placing a deposit, including but not limited to age restrictions, emissions/safety exemptions, and local registration requirements. FNEXS can provide general guidance but does not guarantee import eligibility in any specific jurisdiction.

8. Vehicle Condition

Vehicles are sold as-is, based on the auction sheet grading or dealer listing information available at the time of purchase. FNEXS makes reasonable efforts to accurately represent each vehicle's condition but cannot guarantee against undisclosed defects, particularly for auction vehicles where physical pre-purchase inspection is not possible. Buyers may request additional inspection services at their own cost prior to purchase.

9. Limitation of Liability

To the fullest extent permitted by law, FNEXS's total liability for any claim arising from a transaction shall not exceed the total fees paid to FNEXS for that specific transaction. FNEXS is not liable for indirect, incidental, or consequential damages, including lost profits or loss of use.

10. Governing Law

These Terms are governed by the laws of Japan. Any disputes arising from these Terms or a transaction shall be resolved through good-faith negotiation in the first instance, and if unresolved, submitted to the courts of Japan.
